Welcome to Talko. These Terms of Service ("Terms") apply to the Talko mobile application ("App") provided by iHuman Fantastic Limited ("we", "us", "our", or "Company"). By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

1. Acceptance of Terms

By downloading, installing, or using the Talko App, you confirm that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and iHuman Fantastic Limited.

If you are using this App on behalf of a minor, you confirm that you have the authority to agree to these terms on behalf of that minor and assume full responsibility for the minor's use of the App.

2. Service Description

Talko is an AI-powered English learning application designed to help users improve their English speaking skills through the following features:

  • AI Conversation Practice: Practice English conversations with AI
  • Pronunciation Analysis and Feedback: Real-time pronunciation evaluation and improvement suggestions
  • Interactive Learning Exercises: Personalized learning paths and exercises
  • Progress Tracking: Learning progress and achievement tracking

Our App is provided through the Apple App Store on iOS devices.

No Registration or Login Required: Talko does not require users to register an account or log in. All your data is associated and managed through device identifiers.

3. Use of the Application

The App is intended for personal and educational purposes only.

You agree not to reproduce, duplicate, copy, sell, trade, resell, or exploit any portion of the App for commercial purposes.

You shall not engage in any activity that disrupts or interferes with the App, including transmitting viruses, malware, or any other harmful computer code.

4. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, software, and documentation, are the exclusive property of iHuman Fantastic Limited and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes, subject to these terms. You shall not:

  • Copy, modify, or distribute any part of the App
  • Use the App for commercial purposes without our written permission
  • Remove or alter any proprietary notices

5. Privacy Policy

We are committed to protecting your privacy. Please review our Privacy Policy which details how we collect, use, and protect your personal information. You consent to our use of your data in compliance with this policy.

6. Subscription and Payment

6.1 Subscription Plans

We offer auto-renewable subscription plans, which may include:

  • Free Trial Period (typically 3 days)
  • Weekly or Annual Subscription Options
  • Premium Features Access

6.2 Payment Methods

Payments will be charged to your Apple iTunes Account upon confirmation of purchase.

Important: All payments are processed through the Apple App Store system. We do not store or collect your credit card information or other financial details.

6.3 Auto-Renewal

Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period.

How to Cancel Auto-Renewal:

  1. Go to iPhone Settings > Apple ID > Subscriptions
  2. Select Talko
  3. Toggle off the "Auto-Renewal" switch

Subscriptions will cease at the end of the current billing period.

Important: Deleting the App or clearing your data will not automatically cancel your App Store subscription or turn off auto-renewal.

6.4 Restore Subscription

If you install Talko on a new device or change devices:

  1. Open the Talko App
  2. Go to "Mine"
  3. Tap "Restore Purchases"
  4. The system will verify your subscription status on your Apple ID and restore access

Device Limitation: You may use your subscription on multiple devices that are signed in with the same Apple ID used for the subscription.

6.5 Cancel Subscription

You may cancel your subscription at any time through iPhone Settings:

  1. Go to iPhone Settings > Apple ID > Subscriptions
  2. Select Talko
  3. Tap "Cancel Subscription"

Subscriptions will cease at the end of the current billing period.

Important: Deleting the App or clearing your data will not automatically cancel your App Store subscription or turn off auto-renewal.

6.6 Free Trial

  • Free trials are available only for new subscribers
  • At the end of the free trial period, your subscription will automatically renew unless you cancel
  • To avoid charges, please cancel before the trial period ends

7. Refund Requests and Consumption Information

If you request a refund for an In-App Purchase or auto-renewable subscription through the App Store, and if you provide your consent, we may share information about your use or consumption of the purchased content or services with Apple.

This information is provided solely for the purpose of assisting Apple in reviewing and making a decision on your refund request, in accordance with App Store policies.

The consumption information may include, but is not limited to, usage duration, accessed features, or consumed content associated with the purchase.

We will only share such information after you initiate a refund request and only to the extent permitted by applicable laws and App Store requirements.

8. Content Policy

8.1 Prohibited Content

You shall not create, upload, or transmit the following content within the App:

  • Any illegal, harmful, threatening, abusive, or otherwise offensive content
  • Defamatory content against any individual
  • Any activity that interferes with other users' use of the App
  • Content that infringes on third-party intellectual property rights

9. AI-Generated Content Disclaimer

9.1 AI Content Accuracy

You understand and agree that:

  • Responses and suggestions provided by the App are generated by AI systems
  • We cannot predict, edit, or control the creation of AI content
  • Talko is not responsible for the accuracy of AI-generated content
  • AI content may reflect biases in training data
  • AI content may be incomplete, inaccurate, or misleading

9.2 Usage Risks

You should use the AI content provided by the App with caution. We recommend that you:

  • Independently evaluate the appropriateness of AI content
  • Verify suggestions provided by AI before taking action
  • Avoid using AI content as the sole basis for professional decisions

You assume the risk for any actions taken based on AI content.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any express or implied warranties, including but not limited to:

  • Implied warranties of merchantability and fitness for a particular purpose
  • Non-infringement warranties

11. Limitation of Liability

To the maximum extent permitted by law, iHuman Fantastic Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Costs of substitute services
  • Any other intangible losses

12. Changes to the Agreement

We reserve the right to modify this Agreement at any time. We will notify you of any changes by posting the new Agreement on the App and updating the "Effective Date."

Your continued use of the App following any modifications signifies your acceptance of the revised terms.

13. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates this Agreement, is harmful to other users, or for any other reason at our discretion.

14. General Provisions

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These terms, together with our Privacy Policy, constitute the complete agreement between you and iHuman Fantastic Limited regarding the use of the App and supersede all prior agreements and understandings.
